1. You agree to pay Zipcar the penalties set out in this schedule, plus
the fees and related costs incurred, for the specified violation of one
or more of the following Rules:
1.1. Returning a vehicle late (in addition to the per hour fees for use
of the vehicles):
$50 ($35 CAD) per late hour or any part thereof
1.2 Charges for canceled or shortened reservations:
a. There is no charge for a reservation under 8 hours canceled or shortened
up to 3 hours before it begins. Reservations 8 hours or longer can be canceled
24 hours in advance with no charge.
b. For reservations under 8 hours canceled or shortened less than 3 hours
before they begin, you will be charged for the reservation. For reservations
8 hours or longer that are canceled within 24 hours of their start, you
will be charged for the reservation or any remaining portion of it up to
a maximum charge of one daily rate for that usage.
c. Zipcar will charge a $3.50 Service Charge for reservations, extensions
or cancelations which are made by a Member Services representative and
not through the web site or automated phone system as outlined in section
5.5 of the Contract.
1.3 General penalty:
Zipcar will charge $50 ($65 CAD) per violation, plus any costs incurred
by Zipcar (including all repair and recovery costs, legal fees, including,
without limitation, attorneys' fees) anytime a visit to the vehicle is required
(including visits due to pets or smoking in the vehicle, which are prohibited
as stated in Rules of Vehicle Use).
Zipcar will charge $20 ($30 CAD) per violation, plus any costs incurred
by Zipcar, for any other failure by a Member to comply with any provision
of the Contract or the Rules, other than
for those violations for which a penalty is specifically provided in this
schedule. Without limiting the generality of the foregoing, you will be
charged a penalty for any oversight, omission, or negligence on your part
that inconveniences Zipcar or other Members, such as failing to return or
losing the keys to a vehicle, failing to turn off a vehicle's headlights,
causing or permitting damage to a vehicle which requires repair or cleaning
of such vehicle (internal or external), returning a vehicle to the wrong
place or leaving the car in a restricted parking zone, not paying a parking
ticket, returning a vehicle with a gas tank that is less than 1/4 full,
failing to advise Zipcar immediately of any theft, vandalism or damage relating
to the vehicle, etc. Members charged for such costs shall be entitled to
an itemized list of charges. Members may be charged for estimated costs
pending final repair.
2. In accordance with section 6.5 of the Contract, Zipcar reserves the right
to cancel a Member's contract in addition to levying the aforementioned
penalties if such Member fails to comply with any of the terms and conditions
of the said Contract or the Rules.
3. Amendments - In accordance with Section 2 of the Contract, Zipcar reserves
the right to amend the terms and conditions of the present Schedule from
time to time after the initial term as it sees fit or necessary, without
prior notice. Notice of any change in the terms of these Rules will be delivered
to Members in the manner set forth in the Contract  |
