Zipcar Membership Pilot Plan Program
Zipcar is offering members of the Zipcar service the opportunity to join our Membership Pilot Plan Program ("Pilot Plan" or “Program”) By participating in a Pilot Plan, members acknowledge that they are bound by these Terms and Conditions (“Terms”).
1. Membership. By joining the $15 pilot plan, member will receive a 10% discount on all driving rates. By joining the $25 pilot plan, member will receive a 15% discount on all driving rates, included Premium Damage Waiver Protection (typically $12.99/month or $111.00/year), and allotted mileage of 400 miles per day (as opposed to the standard 180 miles per day). Any additional mileage used per day will be billed at $0.58/mile upon completion of your trip. Members will be charged monthly and will receive these benefits for the duration of the Pilot Plan, which will occur for three monthly billing cycles starting in November 2023.
2. Privacy. All personal information collected, processed and used as part of the Program will be used in accordance with Zipcar’s Privacy Statement, which is available by link on the Site.
3. Restrictions. To qualify for joining the Program, the member must have a current non-discounted Zipcar account. Zipcar reserves the right to terminate the membership of any member who violates or attempts to violate the Terms and/or these rules and restrictions.
4. Liability. MEMBER UNDERSTANDS AND AGREES THAT THE RELEASED PARTIES (DEFINED BELOW) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). By participating in the Program, Member agree to defend, indemnify, release and hold harmless Zipcar, and their respective parent companies, affiliates and subsidiaries, together with their respective employees, directors, officers, licensees, licensors, shareholders, attorneys and agents (collectively, the “Released Parties”), from any and all claims, actions, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to the Program.
5. Disclaimer of Warranties. MEMBER EXPRESSLY UNDERSTANDS AND AGREES THAT: (A) THE PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND ZIPCAR EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND TERMS OF ANY KIND, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED TO, WARRANTIES AS TO PRODUCTS OR SERVICES OFFERED THROUGH THE USE OF THE PROGRAM, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) THE RELEASED PARTIES MAKE AND GIVE NO WARRANTY THAT (i) THE PROGRAM WILL MEET YOUR REQUIREMENTS, (ii) THE PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, AND (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE PROGRAM WILL MEET EXPECTATIONS, AND (C) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PROGRAM IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL.
6. Right to Cancel, Modify or Terminate. Zipcar reserves the right to cancel, modify or terminate the Program at any time for any reason. Zipcar reserves the right to disqualify any user of the Program at any time from participation in the Program if he/she does not comply with any of these Terms. All of Zipcar's decisions are final and binding. Members reserve the right to end their participation in the Program at any time, by contacting Member Services at 1-866-494-7227 or submitting an online request under My Account, settings, or preferences at: https://support.zipcar.com/hc/en-us/requests/new
7. Applicable Law. This Program shall be governed by and construed in accordance with law of the Commonwealth of Massachusetts without regard to conflicts of laws provisions thereof. The parties agree that the sole jurisdiction and venue for actions related to the subject matter hereof shall be the state and federal courts located in Boston, Suffolk County, Massachusetts, and consent to the exclusive jurisdiction of such courts.
